The owner of this web page is Lindyhop SL (from now on this will be referred to as SWINGCATS), with CIF B-66221326, registered in the Barcelona Mercantile Register (Registro Mercantil de Barcelona) on 05/12/2014, Tome 44309, Page 452366, Folio 158 and the business residence on Calle Torrijos,70, Gràcia district, Barcelona.

3.-OBJECT AND AMBIT OF APPLICATION
3.1. The navigation, access and use of the website Swingctas SL confers the condition of the user, by which they accept, through the navigation of the pages of Lindyhop SL, all of the established conditions of use here without challenging the enforcement of the corresponding obligatory legal requirements in each specific case. The web pages of Lindyhop SL provide a wide breadth of information, services and facts. The user assumes their responsibility of correct use of the website.
3.2. SWINGCATS reserves the right to modify at any time and without previous notice the offer of products and prices on the WEB SITE or in any other aspect of the present legal statement, including the condition of booking, if such modifications should respect the operations already practiced with the students.
3.3. The use of certain offered services to the students through the WEB SITE can be found correlated with their own particular conditions that, depending on each specific case substitute, complete and/or modify the present Legal Conditions. Therefore, before using these services, the student should read attentively and accordingly accept the corresponding particular Conditions.
4.- ADULTS
4.1. The access to the WEB SITE and the booking of dance classes are intended for individuals 18 years old and over.
4.2. Without challenging the former statement, minors will be able to book dance classes offered on the WEB SITE with previous written permission of their parents, guardians or legal representatives, who are considered legally responsible for all of the actions of the minors under their charge.
5.- INTELLECTUAL AND INDUSTRIAL PROPERTY
5.1. SWINGCATS is the owner of the intellectual and industrial property rights, or it has obtained the authorizations or licenses necessary for their use, associated with the domain name, the brands and distinct signs, the enforcement, the publication content, the computer programs and the rest of the works and content of its creations or related to this web site and the technology associated with the same.
5.2. The contents of this WEB SITE, including the designs, enforcements, text, images, protected codes, and audio and video archives (“Content”), are protected by intellectual and industrial property rights.
5.3. The contents of this web site will not be able to be used, reproduced, copies, transformed or transmitted en any form without previous permission, written and expressed by SWINGCATS.
5.4. SWINGCATS does not assume responsibility for the intellectual or industrial property rights that the providers include in their announcements.
6.-PROTECTION OF PERSONAL DATA AND IMAGERY RIGHTS
6.1. In fulfillment of the Art. 5 of the Organic Law 15/1999 on the 13th of December of Protection of Data: Right of information in the collection of data, we communicate to you that we commit to guaranteeing the privacy of your personal data collected in your file.
We inform you that the collected Data of Personal Character will be incorporated in a file under our responsibility, for the treatment of data, to this end: Managing your student file in the legal framework and the commercial prospection of the products and services that SWINGCATS offers. This way we inform you that the photos taken in related activities with SWINGCATS will be able to be displayed in the school or on the web page.
6.2. We inform you that you can exercise your rights of access, rectification, cancellation and opposition at any time by means of written mail attaching a copy of the DNI or equivalent documentation to the postal address indicated above or by email to info@swingcats.cat, indicating clearly the right that you wish to exercise.
6.3. SWINGCATS commits to implementing technical and organizational security measures that are adequate and sufficient for guaranteeing the security of the data of personal character as well as guaranteeing the secrecy and confidentiality of the information.
6.4. SWINGCATS will be able to install devices of storage and recovery of data, also known as cookies, in its computer with the goal of knowing information about the visitors to its web site; in no case will said data regard personal data. Its navigator, on occasion, will generate a message informing you that if you continue navigating in the web site you accept the cookies.
6.5. By enrolling, the student gives their consent to SWINGCATS to cede their image to the effect of SWINGCATS being able to use the cited image in publications online and offline to the promotional effects of SWINGCATS and of the dance activities that it organizes.
7. CONDITIONS OF BOOKING
The student that wishes to book any of the offered dance classes in the WEB SITE should accept the following conditions of booking, assuming the status of STUDENT.
7.1. Registration Form.
7.1.2 The student should complete the Registration Form, with all the fields provided to full effect and accept the privacy policy and the conditions of use and booking provided to full effect.
7.1.3 The student should be over the age of EIGHTEEN (18) years or continue with the written authorization of legal representatives.
7.1.4. All the information that the student provides through the services should be truthful. To this effect, the student guarantees the authenticity of all that data that they communicate as a result of the completion of the necessary form for the Service subscription. It will equally be the responsibility of the student to maintain all the information provided to SWINGCATS permanently updated so that it corresponds in each moment with the real situation of the student. In all cases the student will be the only person responsible for the false or inexact manifestations that they make and of the damage they do to SWINGCATS or to third parties through the information they provide.
7.2. Condition of Student and associated documentation
7.2.1. The student (or applicant) will enjoy the condition of STUDENT once their application has been accepted by SWINGCATS and has satisfied the pay of the initial enrollment.
7.2.2. SWINGCATS has complete liberty to accept or reject enrollment applications.
7.2.3. The condition of the STUDENT remains dependent on the associate’s acceptance and fulfillment of these terms and conditions, being bound to both parts.
7.2.4. The STUDENT by formalizing the enrollment declares that they are in good physical shape and are capable of exercising unless it is damaging to their health, safety, comfort or physical condition.
7.2.5. Through acceptance SWINGCATS will be able to expedite a special ID for the STUDENT (only those who are enrolled in regular courses) that will allow said STUDENT to access the facilities where the school’s activities occur and enjoy the rights and benefits that this chosen subscription allows such as enjoying discounts and promotions in collaborating establishments and discounts in the stores, events and various activities that relate in any way to SWINGCATS.
7.2.6. The ID of the associated individual is personal and intransferable, which prohibits the associate from borrowing their ID or authorizing that it may be used by third parties.
7.2.7. The loss of an associate’s ID will result in the charge of 5 euros.
7.3. Rules of Use and Enjoyment of the Facilities
7.3.1 Schedule and Contact
The schedule of the activities of the school as well as the schedule of its operations will be established by SWINGCATS who will be able to modify, add or eliminate any service or activity of the school through notifying the students through the means of contact that are easiest for them.
The daily schedule of opening of the centre will be from Monday to Friday from 5:00pm to 11:00pm. In case of modifications to the said schedule this will be communicated via email or phone call.
The schedule of formal note to the public is Monday to Friday from 5:00pm to 11:00pm.
The schedule for phone calls will be from Monday to Friday from 5:00pm to 11:00pm.

7.3.2. Access and Rules of use of the facilities
7.3.2.1. Access of minors will not be permitted unless they meet the specified requirements (in the section 4.2) of the present contract conditions.
7.3.2.2. The direction of the centre reserves the right of admission.
7.3.2.3. The student will try to respect the facilities of the school for the benefit of all its users.
7.3.2.4. SWINGCATS is not held responsible for the loss of personal objects, sports material or any other type, and such losses will be attributed to a result of distraction or simple loss by neglect.
7.3.2. Holidays and Vacations.
7.3.4.1. Holidays will not be deducted. Said classes will be able to be made up on the days and schedules indicated by the centre.
7.3.4.2. In the academic calendar of SWINGCATS the holidays have been determined.
7.3.3. Absences and makeups.
7.3.3.1. The student may make up the classes that they could not attend for adequately justified motives with other instructors, or with the same professor, at another time having previously advised (with a minimum of TWENTY FOUR hours in advance) their absence via email, whatsapp or phone call. They will propose the possible makeup days according to the class being made up and available space in the dance rooms. Students may only make up missed classes within the same trimester, the classes are not saved for the next trimester.
7.3.3.2. If the student cannot come to class, it is essential to advise the professor with a minimum of 24 hours in advance so that they may make up the class. If they advise the professor of an absence less than 24 hours before class, they may not reclaim the refund nor the restitution of the missed class, but they will not be penalized (read section on penalties 7.3.4)
7.3.3.3.
The makeups will be held in pairs in case the missed classes were in pairs. It can be the regular pair or another student of the school that is enrolled in the same style of dance and is in the same level or higher as the class they are attending with the makeup student.
7.3.3.4. The regular courses may only be made up if the STUDENT has communicated their absence in advance, has paid the monthly payment and the student has not been able to attend for medical reasons, studies or work.
7.3.3.5. If the centre suspends a class, it will designate a date and time to make it up. It will elect that date based on the availability of the centre.
7.3.4. Penalties
7.3.4.1. If the student misses three or more classes without advising their professor in advance, the next trimester they will need to sign up mandatorily with a partner.

7.5. Enrollments and pay.
7.5.1. Agreement:
The STUDENT that pays the enrollment fee DECLARES THEIR COMPLETE AGREEMENT with the rules of SWINGCATS. In the cases of students who are minors, these rules will be confirmed by the mother, father or other legal guardian in charge of this minor, just as they establish in section 4.2 the present contract conditions.
7.5.2. Fees, permanence and refunds:
7.5.2.1 All of the fees submitted to SWINGCATS (monthly pay, intensives, activities, etc) will be paid in cash or via bank transfer.
7.5.2.2. The paid fees are not reimbursable unless SWINGCATS does not execute the activities to which they correspond or there is a change in the time of the activity that impedes the attendance of the STUDENT, in whose case they will receive a full refund of the amount paid. In the case that the student would profit in the purchase of their courses through some discount by accumulation of courses in the same trimester or other cumulative discounts, the amount reimbursed will always be the smallest amount independently of whichever course had been requested in the original purchase. The refund will be given in cash in the same school where the STUDENT will accredit themselves with the DNI.
7.5.2.3. If one time starting the course the STUDENT’s health suffers so that it impedes their ability to come to the classes of that trimester, they will keep the amount of money equivalent to the cost of the number of classes not attended, always and when it is confirmed by a medical report. This money will be kept during the following 6 months to the exact date of the final class completed.
7.5.2.4. Once the fee has been paid, the STUDENT may cancel their enrollment and reclaim 50% of the amount if they do so two weeks in advance to the start of the course, 20% if it is more than a week. If they do so with less time no amount will be returned.
7.5.2.5. Once the course is confirmed, the STUDENT loses the right of withdrawal , except in the case that they want to exchange a course for another of similar or lesser value. In this case, the STUDENT may change the activity, always and whenever it is logically permissable, notifying via mail in advance.
7.5.2.6. The fees may not be modified by SWINGCATS during the duration of the course (monthly or per trimester) but it may be in the renovation of the following course so that the student can decide if they wish to continue accepting the new fees.
8. RESPONSIBILITY LIMITATION.
8.1. The knowledge that is imparted in the training courses are a result of the experience of the people that impart the cited information.
8.2. SWINGCATS will make its best efforts to guarantee the quality of the offered content in its courses and, does not guarantee that the courses meet the expectations of the students at all and any moments.
8.3 SWINGCATS does not assume any responsibility for the external links that, in their case, could be included in the WEB SITE, because it does not have any type of control over them; in consequence, the student will lower their exclusive responsibility to the content and in the conditions of use that apply to them.
8.4. SWINGCATS develops the maximum diligence in the implementation of security steps, however it does not assume any responsibility in relation to the custody and good use of the passwords used to access the WEB SITE, which will be the exclusive responsibility of the student.
9. LEGAL ACTIONS, APPLICABLE LEGISLATION AND JURISDICTION.
9.1. Lindyhop SL reserves its own ability to present civil actions or proceedings that it considers appropriate by the inappropriate utilization of its web pages and contents or by the breach of the present conditions.
9.2. In general, the relations with the users, that benefit from the contained services in this web page, are submitted to Spanish legislation and jurisdiction.
9.3. The users of this web page are conscious of all of the expressed and they accept it voluntarily.
10. CONDITIONS OF USE FOR URBAN SPORTS CLUB and GYMPASS MEMBERS (formerly called ANDJOY)
10.1 Students who want to access the courses must make a prior registration on the Swingcats website. You will receive an automatic email that you must reply saying that they come from Urban Sports Club or Gympass (Andjoy).
10.2 Individual dance courses will be accessible.
10.3 To be able to access the dance courses as a couple, they can only be accessed if they come with the partner, who may or may not be a member of UCS or Gympass, or join the waiting list.
10.4 The courses are organized in packs of 10 classes, they have a progressive agenda so you cannot miss more than 1 class consecutively without justification. The option of recovering it will be given if there is a course with the same characteristics at a different time.
10.5 It is mandatory to make 12 accesses to cover the regular course, regardless of whether the STUDENT attends class or not.
10.6 The chosen courses must be according to their level.
10.7 They will have access to the intensive courses lasting 1 hour (maximum 1 per day).
10.8 They will have access to the parties organized at the headquarters school: c / Torrijos, 70, Barcelona.
